These terms and conditions govern the relationship between the provider and the customer for website creation, monthly operation, website changes and related services.
2. Definitions
- Customer: a person who orders a service from the provider. Services are intended primarily for businesses.
- Deliverable: a website or automation created under an order.
- Monthly operation: hosting, technical administration, backups and website support for a monthly fee.
- Automatic change: a website change that the customer requests in one sentence using the form at svenity.sk/zmena/ with their personal code.
- Úpravy+: a one-off add-on to the monthly plan with a higher number of automatic changes for 30 days.
3. Services and their description
Website creation
The provider creates a website tailored to the customer's business, content, brand and required features within the agreed scope. Scope, price and delivery date are confirmed before work begins.
Monthly operation
- €19/month: hosting, administration, backups, standard support and 1 automatic change per week.
- €29/month: the same, including booking and business email, with 2 automatic changes per week.
- Úpravy+ (€9.99 for 30 days): 5 automatic changes per week. It is paid once in advance and is valid for 30 days from activation. It does not renew automatically, and nothing is added to the monthly operating invoice. The customer can order it again after it expires.
The provider makes small manual changes sent by the customer via email within 48 hours on working days. These are included in the monthly price and do not count towards the automatic change limit.
Extra automatic change
If the customer has used their automatic changes for the week, they may place a binding order on the changes page for another change costing €3.99 with an obligation to pay. When ordering, the customer provides an email address and billing details (business or personal name, address and, where applicable, company ID, tax ID and VAT ID) for the invoice. Payment is made in advance by bank transfer (PAY by square QR code, or by card once the payment gateway is launched). When the customer confirms sending the payment, they may immediately request one change; if payment does not reach the provider's account within 24 hours, that change is automatically reversed. Further changes under Úpravy+ are unlocked once payment is received. If a paid change ends in manual handling, an error or rejection, it remains available for a future change. An unpaid order is cancelled after 14 days.
5. Prices
All prices are in euros (EUR) and are final. The provider is not VAT-registered, so VAT is not added. Current pricing is available at svenity.sk.
The provider will notify the customer of a change to monthly service prices by email at least 30 days in advance. The customer may terminate the service without penalty before the change takes effect.
6. Payment methods
- By bank transfer against an invoice due within 7 days. This is used primarily for website creation, payable in full only after completion and approval, with no deposit.
- Online by payment card through the payment gateway GoPay. This is used only for one-off payments: an extra automatic change (€3.99) and the Úpravy+ package (€9.99 for 30 days). The provider does not use recurring card payments (Article 7).
Card payments are processed by GoPay (GoPay Czech, odštěpný závod zahraniční právnické osoby Worldline NV). The provider has no access to card details. GoPay handles them according to the international security standard PCI DSS Level 1. Payment is protected by 3-D Secure authentication.
Monthly operation is paid in advance for the next period by bank transfer against a monthly invoice. For card payments, the customer receives the invoice by email after payment is received.
Exception: where a one-off hosting buyout is agreed instead of monthly operation, a deposit of 50% of the website price is payable before work starts. The balance (the remaining half of the website price and the full buyout amount) is payable after completion, before going live.
7. Recurring card payments
The provider does not use recurring card payments. A card is never charged automatically, and its details are not stored. Every card payment is a one-off payment confirmed by the customer in the GoPay payment gateway.
The customer pays for monthly operation by bank transfer against a monthly invoice. The Úpravy+ package does not renew automatically; the customer must order and pay for another package themselves. If the provider introduces recurring card payments, it will add their parameters to these terms and set them up only with the customer's express consent.
8. Website delivery and handover
The provider delivers a standard website without booking within 48–72 hours of order confirmation and receipt of the materials. For booking and custom solutions, the date agreed in the order applies.
There are 2 rounds of feedback before launch. The deliverable is handed over once the customer expressly approves it (email is sufficient).
9. Website changes after launch
- The automatic change limit is calculated over a rolling 7-day period from the request. Unused changes do not carry over to the next period.
- Text changes usually appear on the website within 10 minutes. Changes to design, elements or photos are first created as a preview and go live only after the customer's confirmation.
- Every completed change counts towards the limit, even if the customer later reverses it, as does a preview that the customer discards or lets expire. Reversing a change costs nothing extra.
- A change that cannot safely be made automatically will be handled manually by the provider within 48 hours on working days, or the provider will propose an approach and price. Such a change does not count towards the limit.
- Before publication, the system checks every change: only what the customer requested may change, and no third-party code, scripts or links to an external domain may be added. Otherwise, the change is not published and the provider handles it manually.
- The provider will not publish, and may reject, a change containing content that is unlawful, contrary to public morals or infringes third-party rights (for example misleading or offensive statements, or offers of illegal goods or services). It may also remove such content from the website. In that case, a paid change remains available to the customer for a future change.
- The customer is responsible for the content they supply (text, photographs and data).
10. Withdrawal from the contract and termination
The services are intended for businesses for business purposes. If the customer orders as a business, consumer protection law does not apply to the contract and the customer does not have a 14-day right of withdrawal.
If the customer exceptionally acts as a consumer, they may withdraw from a distance contract without giving a reason within 14 days of its conclusion under Slovak Act No. 108/2024 Coll. on Consumer Protection. This right does not apply in the cases specified in Section 19(1) of that Act, in particular:
- if the service, including an automatic change, has been fully provided before the period expires with their express consent and they were informed that this would end their right of withdrawal,
- if the deliverable is made to their specific requirements.
The consumer may withdraw by sending an unambiguous statement to ahoj@svenity.sk or to the provider's address, for example: “I withdraw from the contract for … concluded on …, name, address, date, signature (if on paper).” If the consumer requested that the service start during the withdrawal period, they pay a proportionate amount for services provided before withdrawal.
Monthly operation can be terminated by the customer by email at the end of any paid period, with no minimum term. The Úpravy+ package ends automatically after 30 days.
11. Complaints (liability for defects)
The provider is responsible for the deliverable and services functioning according to the agreed scope.
- How to complain: by email to ahoj@svenity.sk or by phone on +421 940 268 968. Include the website, a description of the fault, when it occurred and ideally a screenshot. Nothing needs to be sent physically.
- Acknowledgement: the provider will acknowledge the complaint by email without undue delay.
- Resolution: the provider will resolve the complaint without undue delay, no later than 30 days after it is submitted, and inform the customer of the outcome by email.
- Time limits: defects reported within 30 days of handover are fixed free of charge, or within 3 months for a one-off hosting buyout. During monthly operation, defects are fixed on an ongoing basis free of charge without a time limit. Consumers retain their rights under the Slovak Civil Code.
- A complaint cannot be accepted if the fault was caused by the customer or a third party modifying the website, content supplied by the customer, a third-party service chosen by the customer (such as a domain or email with another provider), or force majeure. Changes beyond the agreed scope are not defects.
- Card payments: if there is a problem with a card payment, contact the provider first. You may also dispute the payment with your bank.
12. Refunds
- If the customer is entitled to a refund (a justified complaint, consumer withdrawal or an accidental charge), the provider will refund the payment within 14 days.
- The provider refunds card payments to the same card through GoPay and bank transfers to the customer's account. Depending on the bank, a card refund may take several working days to appear.
- If a paid extra automatic change cannot be made either automatically or manually, the provider will refund the full €3.99 or retain it for a future change, at the customer's choice.
- On termination, no refund is given for a monthly operating period that has already started and been paid for; the service continues until the end of that period.
13. Ownership and licences
Until full payment, the deliverable (including source files) remains the provider's property and runs on its hosting. Once fully paid, all rights to content created for the customer (text, photographs, structure and graphics of the specific website) transfer to the customer.
The underlying code and system remain the provider's property. The customer receives a perpetual, non-exclusive licence to operate their own website. For a fully custom design, the scope of rights is agreed in the order.
The domain is always registered in the customer's name and details and belongs to the customer, even if the provider pays for the first year. From the second year, the customer renews it themselves. If the requested name is taken, the first-year payment offer does not apply to it, and the parties will agree on an alternative name.
14. Liability
The provider works to keep the website continuously available but is not liable for outages caused by infrastructure providers, third-party attacks or force majeure; it addresses these without undue delay. Website backups are made regularly.
For business customers, compensation is limited to the amount the customer paid the provider in the preceding 12 months and excludes lost profit. This limit does not apply to damage caused intentionally or through gross negligence.
15. Personal data
The processing of customers' personal data is governed by the document Privacy and cookies.
If the customer's website collects visitors' personal data (for example through a contact or booking form), the provider processes it as a processor only as necessary to operate the website and according to the customer's instructions. The provider will enter into a data processing agreement on request.
16. Dispute resolution
Disputes are primarily resolved by agreement. Consumers may contact Slovenská obchodná inšpekcia, Inšpektorát SOI pre Žilinský kraj, Predmestská 71, P. O. BOX B-89, 011 79 Žilina 1 (soi.sk) or use alternative consumer dispute resolution under Slovak Act No. 391/2015 Coll. The governing law is the law of the Slovak Republic.
17. Final provisions
The provider may amend these terms. For ongoing monthly services, it will notify the customer by email at least 30 days before the change takes effect, and the customer may terminate without penalty before then. Changes do not apply to website creation contracts already concluded.
You can save or print these terms (Ctrl + P). We send them by email with the order confirmation.
